By submitting the registration form or making any payment towards plot booking at Shree Hari Enclave, Haridwar ("the Project"), you ("the Applicant") agree to be bound by these Terms and Conditions in their entirety.
If you do not agree to any part of these terms, you must not proceed with registration or payment. Use of this website or submission of any application shall constitute acceptance of these terms.
To register for a plot at Shree Hari Enclave, the Applicant must:
- Be at least 18 years of age at the time of application.
- Be an Indian citizen or an NRI/OCI cardholder eligible to purchase immovable property in India under applicable laws.
- Possess valid government-issued photo identification (Aadhaar Card, PAN Card, Passport, or Voter ID).
- Not be an undischarged insolvent or otherwise legally barred from entering into contracts.
- Provide accurate, complete, and truthful information in the registration form.
The Developer reserves the right to reject any application that does not meet the above eligibility criteria, with or without assigning reasons.
The online registration form collects basic applicant information for the purpose of plot allotment enquiry. Submission of the registration form does not guarantee allotment of any specific plot or unit.
- All fields marked as mandatory in the registration form must be completed accurately.
- The Applicant is responsible for the correctness of information submitted. Any misrepresentation may lead to cancellation of the application without refund.
- Upon submission, an application reference number (SHE-XXXXXX) will be generated. This number must be quoted in all future correspondence.
- Our team will contact the Applicant within 48 working hours of receipt of the application.
- Registration fee of ₹31,000 is payable only after confirmation from the Developer's representative.
All payments must be made by the Applicant as per the payment schedule communicated at the time of allotment. The following conditions apply:
- Registration fee of ₹31,000 is payable via NEFT, IMPS, account payee cheque, or in person at our registered office.
- Cash payments above the limits prescribed under Indian law will not be accepted.
- All cheques must be drawn in favour of "Shree Hari Enclave". Post-dated cheques shall be deposited on the date mentioned.
- In case of cheque dishonour, the Applicant will be liable for a penalty of ₹500 per instance, in addition to bank charges.
- Failure to pay any instalment within the due date may result in levy of interest at 12% per annum or such other rate as communicated in the Allotment Letter.
- The Developer reserves the right to cancel the allotment in case of prolonged default, subject to the Refund & Cancellation Policy.
Plot allotment is subject to availability and sole discretion of the Developer. The following terms govern allotment:
- Unit allotment will be communicated in writing via an Allotment Letter to the Applicant's registered address and/or email.
- Plot numbers, area (in sq. yards), and exact location within the layout are subject to final approved RERA layout.
- The Developer reserves the right to make minor modifications to plot dimensions not exceeding 5% without additional compensation or liability.
- Possession shall be handed over upon completion of construction of essential infrastructure and receipt of all pending payments from the Applicant.
- The Applicant may not transfer, assign, or sub-let the plot prior to execution of a registered Sale Deed without prior written consent of the Developer.
Shree Hari Enclave is registered under the Real Estate (Regulation and Development) Act, 2016 with the Haridwar Real Estate Regulatory Authority, Government of Uttarakhand.
- All project disclosures, approvals, and documents are available on the RERA portal.
- Any disputes arising from this transaction may be referred to the Haridwar RERA Adjudicating Authority.
- The Developer shall adhere to the timelines and obligations as specified in the registered RERA project documents.
- In the event of any conflict between these terms and the RERA Act, the provisions of the RERA Act shall prevail.
The Applicant must provide the following KYC documents at the time of registration confirmation:
- Identity Proof: Aadhaar Card, PAN Card, Passport, or Voter ID (self-attested copy).
- Address Proof: Aadhaar Card, Utility Bill, Passport, or Bank Statement (not older than 3 months).
- PAN Card: Mandatory for transactions above ₹50,000 as per Income Tax Act.
- Photographs: 2 recent passport-size photographs.
- For joint applicants, KYC documents of all co-applicants are required.
Failure to provide complete documentation within 7 days of the confirmation call may result in cancellation of the application.
To the maximum extent permitted by applicable law:
- The Developer shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the registration or allotment process.
- The Developer's total liability to any Applicant shall not exceed the amount of registration fee actually paid by that Applicant.
- The Developer is not liable for delays or failures in performance caused by circumstances beyond its reasonable control (see Force Majeure clause).
- Information on this website is provided in good faith for general informational purposes. While we strive for accuracy, we make no warranties regarding completeness or accuracy of project details.
The Developer shall not be held liable or in breach of these terms for any failure or delay in performance arising out of causes beyond its reasonable control, including but not limited to:
- Natural disasters, floods, earthquakes, or other acts of God.
- War, civil unrest, terrorism, or government-imposed restrictions.
- Pandemic, epidemic, or public health emergency declared by a competent authority.
- Strikes, lockouts, or labour disputes.
- Regulatory changes or delays in statutory approvals.
In case of a force majeure event, the Developer shall notify applicants and make commercially reasonable efforts to resume performance at the earliest opportunity.
The Developer reserves the right to modify, update, or replace these Terms and Conditions at any time. Changes will be effective immediately upon posting on the project website.
It is the responsibility of the Applicant to review these terms periodically. Continued use of the registration facility after any changes shall constitute acceptance of the revised terms. For material changes, we will endeavour to notify registered applicants via email or SMS.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these terms or the Project shall be subject to:
- First, the jurisdiction of the Haridwar RERA Adjudicating Officer for matters covered under the RERA Act, 2016.
- For matters outside RERA jurisdiction, the courts at Haridwar, Uttarakhand shall have exclusive jurisdiction.
